Terms of Service

1. Acceptance of Terms

By creating an account or using GameLense ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Marshall Digital Solutions LLC ("Company," "we," "us," or "our"), the owner and operator of GameLense.

2. Service Description

GameLense is a youth baseball analytics platform designed for coaches, parents, and organizations. The Service provides tools to upload and analyze player statistics, generate lineup and pitching rotation recommendations, track player development trends, and manage team rosters. GameLense aggregates and processes baseball performance data to deliver data-driven insights that support team management decisions.

3. User Accounts

• Age requirement: You must be at least 18 years of age to create an account on GameLense. The Service is not intended for use by minors. Children do not create accounts; all player data is entered and managed by authorized adults such as coaches or parents.
• Account security: You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
• One account per person: Each account is for a single individual. You may not share your account credentials with others or create multiple accounts for the same person.

4. User Roles

GameLense supports several user roles, each with specific capabilities:

• Coaches: May upload player statistics, manage team rosters, and access team-level analytics including lineup recommendations, pitching rotation tools, and practice planning features.
• Parents: May view their linked child's statistics, development trends, and performance data. Parent access is limited to the player(s) they are linked to by an authorized coach.
• Organization Owners: May manage multiple teams under a single organization, access cross-team visibility and analytics, and administer coach assignments across their organization.

5. Data Ownership

• You retain full ownership of any data you upload to or create within GameLense, including player statistics, roster information, and any other content you provide.
• By using the Service, you grant GameLense a limited, non-exclusive license to process, store, and display your data solely for the purpose of providing and improving the Service.
• You may request a copy of your data or its deletion at any time by contacting privacy@gamelense.app. Upon account deletion, we will remove your data from our active systems within 30 days, subject to any legal retention requirements.

6. Acceptable Use

You agree not to:

• Upload false, misleading, or fabricated player data or statistics.
• Attempt to access, view, or modify data belonging to other teams or users without authorization.
• Use automated tools, bots, scrapers, or other programmatic means to access, collect, or extract data from the Service without our express written consent.
• Engage in harassment, abuse, or any inappropriate conduct toward other users through the Service.
• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.

7. Payment Terms

• Billing: Subscription fees are billed through Stripe, our third-party payment processor. By subscribing, you authorize us to charge your designated payment method on a recurring basis.
• Auto-renewal: Subscriptions automatically renew at the end of each billing cycle unless you cancel before the renewal date. You may cancel your subscription at any time via the billing page in the web app or the More screen in the GameLense mobile app.
• Refund policy: If you cancel within the first 14 days of a new subscription or renewal, you are eligible for a prorated refund for the unused portion of your billing period. After 14 days, no refunds will be issued for the current billing cycle.
• Organization subscriptions: Organization-level subscriptions cover all teams managed under that organization. Individual team billing is not required when covered by an active organization subscription.

8. Disclaimers

• All analytics, insights, lineup suggestions, and pitching rotation recommendations provided by GameLense are data-driven suggestions only. They do not constitute professional coaching advice and should not be treated as a substitute for the judgment of qualified coaches.
• Lineup and rotation recommendations are decision-support tools, not guarantees of performance outcomes.
• THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MARSHALL DIGITAL SOLUTIONS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in fraudulent or harmful activity, or otherwise misuse the Service. We will make reasonable efforts to notify you before termination, except where immediate action is required to protect the Service or other users. You may request account deletion at any time via the GameLense mobile app or by emailing privacy@gamelense.app. Upon termination, your right to use the Service ceases immediately, though Sections 5, 8, 9, and 12 of these Terms shall survive termination.

11. Changes to Terms

We may update these Terms from time to time. For material changes, we will notify you via the email address associated with your account at least 30 days before the changes take effect. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of those changes. If you do not agree to the updated Terms, you must stop using the Service and close your account.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in the State of Georgia, and you consent to the personal jurisdiction of such courts.
